Community activist Wilbur Haines has filed a small-claims lawsuit challenging the Rancho Murieta Association's plans to lift a moratorium that halted the RMA process of granting homeowners exclusive use of common land.
Haines, an attorney, filed the suit Tuesday. At the July RMA board meeting, he challenged the association's policy and said a small-claims test might be a good way to resolve the disagreement.
Under the RMA's CC&Rs, owners of cottage, townhouse and circle lots can lease up to 1,200 square feet of common area immediately adjacent to their homes for heating and air conditioning equipment, propane tanks, decking, unroofed patios, landscaping and swimming pools.
